Terms of Use

These Terms of Use (“Terms”) govern your use of Read to Speak, operated by Read to Speak, LLC, doing business as Read to Speak Media (“Read to Speak,” “we,” “us,” or “our”).

Acceptance of these Terms

By accessing or using Read to Speak, including readtospeak.com and spanish.readtospeak.com, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

The service

Read to Speak provides Spanish readings, comprehension activities, vocabulary support, learner-level and progress features, and related educational tools. The service is designed to support language learning; it does not promise a particular learning outcome, proficiency level, credential, or result.

Accounts and eligibility

You must provide accurate account information, keep your credentials confidential, and promptly notify us of unauthorized account use. You are responsible for activity through your account to the extent permitted by law.

Independent consumer accounts are available only to users age 13 or older. If you are under 18, you must have permission from a parent or legal guardian. Institutional use may be governed by the applicable school or college's policies.

Subscriptions and recurring billing

Independent learners may subscribe to a monthly plan at $5 per month or an annual plan at $49 per year. Prices are shown before checkout and may be changed prospectively with notice where required.

Payments are processed through Stripe Checkout. By starting a paid subscription, you authorize Stripe and Read to Speak to charge the applicable recurring fee and any applicable taxes at the start of each subscription period until you cancel. A monthly subscription renews monthly; an annual subscription renews annually.

Some Tacoma Language Academy learners may receive access through their program and do not need to purchase an independent subscription.

Cancellation and access after cancellation

You can cancel an independent subscription through the subscription-management option in the service when Stripe Billing Portal access is available. A cancellation scheduled for the end of a paid period does not immediately end access: the application preserves access through that paid period. When the paid period ends, learning access may end, but your account and learning history are not automatically deleted.

Subscription payments are nonrefundable. You may cancel your subscription at any time. Cancellation prevents future renewal charges, and your access continues through the end of your current paid subscription period. Refunds may be provided where required by applicable law.

Acceptable use

You may use the service only for lawful, personal, educational, or authorized institutional purposes. You may not interfere with the service; attempt to bypass access controls; access another person’s account; scrape, copy, redistribute, sell, or exploit service content except as authorized; upload malicious code; or use the service in a way that violates applicable law or another person’s rights.

Intellectual property

Read to Speak and its licensors retain all rights in the service, including its readings, activities, software, design, trademarks, and other content. Subject to these Terms, we grant you a limited, personal, non-transferable, revocable right to use the service for its intended purpose. These Terms do not transfer ownership to you.

Third-party services

The service uses third-party services, including Stripe for payment processing and Mailgun for email delivery. Your use of those services may also be subject to their own terms and privacy notices. We are not responsible for third-party services outside our reasonable control.

Availability and changes

We may change, suspend, or discontinue all or part of the service, including readings, activities, features, plans, or availability. We will use reasonable efforts to provide notice of material changes when appropriate, but the service may be unavailable for maintenance, security, technical, or other reasons.

Suspension and termination

We may suspend or terminate access when we reasonably believe these Terms have been violated, use is fraudulent or harmful, payment is not received, or suspension is required to protect the service or comply with law. You may stop using the service at any time. Ending access does not necessarily delete account or learning-history information; see the Privacy Policy.

Disclaimers

The service is provided on an “as is” and “as available” basis to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, noninfringement, accuracy, and uninterrupted or error-free service. Nothing in these Terms limits a warranty that cannot be disclaimed under applicable law.

Limitation of liability

To the fullest extent permitted by law, Read to Speak and its owners, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business interruption arising from or related to the service. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

Governing law and disputes

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Any action arising out of or relating to these Terms or the service must be brought in the state or federal courts located in Pierce County, Washington, and you consent to their jurisdiction and venue.

Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms here and revise the “Last updated” date. Continued use after updated Terms take effect means you accept them, to the extent permitted by law.
